Terms & Conditions for Visitors

of SUPERBOOTH events (Superbooth Berlin GmbH) - as of October 10th 2024

 

1. TICKETS

  1. By purchasing a ticket for SUPERBOOTH, the ticket buyers and Superbooth Berlin GmbH, as the organizers, become contractual partners. Admission to SUPERBOOTH is limited. TixforGigs (Fluffy Clouds GmbH & Co. KG) is the authorized ticketing partner of Superbooth Berlin GmbH and handles all payment services.
  2. The purchased admission ticket may not be resold. Additionally, using it for raffle purposes and/or conducting contests is prohibited without prior express written consent from the organizers. A violation will result in the loss of admission rights without compensation.
  3. No replacement will be provided in the case of loss of the ticket.

2. ACCESS, BEHAVIOR, AND SECURITY CHECKS

  1. Individuals under 18 years of age may only attend the event when accompanied by a legal guardian. The event organizers may request age verification.
  2. Admission is only allowed with a valid ticket, which must be presented upon entry to the venue. In exchange for the ticket, attendees will receive a wristband that must be worn throughout the event. The wristband must be shown when requested by staff.
  3. Access may be denied if attendees wear clothing or exhibit behavior that conveys demeaning or discriminatory statements regarding gender and gender identity, ethnicity, religion, origin, skin color, religious beliefs, sexuality, socioeconomic status, disability, body shapes and types, or age. Forbidden items such as glass containers, drones, pyrotechnic devices, torches, weapons, or animals are also not allowed. Furthermore, entry may be refused if attendees refuse to undergo bag or security checks by staff.
  4. Attendees have the right to a refund of the ticket price in the case of denial of entry despite having a valid ticket, unless there is a significant reason for the denial of entry, particularly the aforementioned reasons in section 2.3. In such cases, returning the ticket or receiving a refund of the ticket price is not possible. Any further claims for damages are excluded unless the organizers act with intent or gross negligence.
  5. Those who leave the venue will be granted re-entry if they present their entry authorization (for example, by showing an undamaged wristband).
  6. The organizers accept no responsibility for supervising individuals who require care due to their mental or physical condition.

3. HOUSE RULES AND PROHIBITIONS

  1. The organizers have the right to exercise house rules at all times on the event premises. The instructions of the organizers, third parties appointed by them and security personnel must always and promptly be followed before, during, and immediately after the event.
  2. Sales and/or advertising are prohibited on the premises unless previously arranged in writing with the organizers. Bringing animals onto the premises is not allowed.
  3. A violation of the instructions of the organizers, third parties appointed by them, or security personnel may result in denial of access or expulsion from the event area, depending on the severity of the violation. Attendees may particularly be expelled from the event area or denied entry if they disturb the event and/or harass other attendees, as well as in situations outlined in section 2.3.
  4. In the case of a legitimate denial of entry or valid expulsion, there is no right to compensation. The ticket price will not be refunded in these cases.

4. POSTPONEMENT/RELOCATION OF THE EVENT AND PROGRAM CHANGES

  1. The organizers reserve the right to change the program or adjust entry times without prior notice. Changes in the programming do not entitle the ticket holder to withdraw from the contract, return the tickets, or reduce the purchase price. The organizers have no influence over the design and content of the artists' performances.
  2. Due to force majeure, the organizers reserve the right to postpone the event. If the event is canceled due to a government order or force majeure, there is no right to a refund. If an ongoing event must be canceled, no compensation will be provided.

5. VOLUME AND HEARING PROTECTION

  1. Visitors to the event are advised to bring suitable hearing protection. The organizers are not liable for hearing damage that occurs due to a lack of precaution unless they act with gross negligence or intent or fail to fulfill their duty of care.

6. FOOD AND DRINKS

  1. Drinks will be served on the event premises. There is a deposit on this tableware. Please be mindful of the environment and dispose of trash in the designated containers.
  2. Bringing food and drinks is prohibited.
  3. When purchasing food and drinks, contractual relationships are established with the respective vendor, not with the organizers.

7. PHOTOS, RECORDING DEVICES

  1. Photography on the premises is only allowed with mobile phones equipped with cameras and only for personal use.
  2. Any use of image and sound recordings for commercial purposes is prohibited without prior written consent from the organizers. In the event of a violation, a contractual penalty of €10,000 will be imposed. The right to claim any additional damages remains reserved.
  3. During the event, numerous photos and film recordings will be made, which may be published for the purpose of event reporting, post-reporting, and general public relations in various media.

8. SMOKING

  1. Smoking is not permitted in the entire building.
  2. Smoking is only allowed in designated smoking areas on the entire event premises, including the fenced outdoor area of FEZ-Berlin.

9. LIABILITY

  1. Claims for damages arising from positive breach of duty, fault in the conclusion of the contract, and unlawful acts are excluded unless the organizers, their legal representatives, or their agents have acted with intent or gross negligence. Claims for damages due to impossibility of performance and delay are limited to the foreseeable damage in cases of slight negligence. The organizers are not liable for damaged, lost, stolen, or otherwise missing items. Using the cloakroom is at the user's own risk.

10. USAGE AND ADVERTISING RIGHTS

  1. By entering the exhibition grounds, visitors irrevocably agree that photos and audio/video recordings may be made of them during the event, which may be used free of charge for reporting as well as future promotion of the event in all media. They also agree that this material may be used for sponsorship acquisition. This consent only applies to incidental or accessory recordings of visitors during the event recording.

11. DATA PROTECTION

  1. The organizers store and process the data provided by the ticket buyer for the purposes of mutual contract fulfillment. The organizers may only use the data to inform visitors (e.g., event information, newsletters, etc.).

12. FINAL PROVISIONS

  1. Side agreements, changes, and additions must be in writing. This also applies to the requirement for written form itself. The law of the Federal Republic of Germany applies. If a jurisdiction agreement is permissible, the jurisdiction is Berlin. If individual provisions of these terms and conditions are or become ineffective, this does not affect the legal validity of the remaining provisions. The same applies to any contractual gaps. In such cases, the legally ineffective provision or contractual gap shall be replaced by a legally valid provision that comes closest to the economic purpose pursued by the parties with the ineffective or overlooked provision.
